Official Rules
1. Eligibility: NO PURCHASE NECESSARY. NOS “24 Hour Endurance” Sweepstakes (the “Sweepstakes”) is open only to legal residents residing within the contiguous United States who are at least 18 years of age or older. Employees, officers and directors of The Coca-Cola Company, Fuze Beverages LLC, and their advertising and promotion companies, their divisions, subsidiaries, parent companies and affiliates, as well as the spouses, children, parents, grandparents and household members of each such employee, officer or director are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: The Sweepstakes is sponsored by High Performance Beverage Company, 140 Sylvan Ave. Suite 3G Englewood Cliffs NJ, 07632.
3. Administrator: The Sweepstakes is administered by High Performance Beverage Company, 140 Sylvan Ave. Suite 3G Englewood Cliffs NJ, 07632.
4. Timing: Online Sweepstakes begins July 11, 2008 at 12:01 p.m. Eastern Time ("ET") and ends at 11:59 p.m. ET July 27, 2008 (“Sweepstakes Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes.
5. How to Enter: During the Sweepstakes Period, visit www.DrinkNOS.com and follow the online instructions to enter. Limit one entry per person or email address. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or entrant. The potential winner may be required to show proof of being the authorized account holder.
6. Prizes: 17 NOS Prize Packages will be awarded to legal residents residing within the contiguous United States. Each Prize Package consists of one 4pk of 16 fl. oz. NOS, one pack NOS Powershot, one NOS T-Shirt, one NOS Hat, one NOS Lanyard and NOS Decals Prizes. The approximate retail value of each Prize Package is $75. Winners must reside within the contiguous United States at time of delivery.
The first 200 entrants will receive via mail one coupon for a free 16 fl. oz. NOS Energy Drink worth approximately $2.50.
Prizes are not transferable or refundable. No cash or other substitution is allowed except by Sponsor who may substitute a prize with another prize of equal or greater value if the advertised prize becomes unavailable, as determined by Sponsor in its sole discretion. Winners are solely responsible for all federal, state and local taxes and other fees associated with prize receipt and use.
7. Drawings: The 17 entrants to receive NOS Prize Package will be determined by a random drawing by Administrator on July 29, 2008.
Administrator is an independent judging organization whose decisions as to the selection of the potential winners are final and binding. The odds of winning a prize in either drawing depends on the number of eligible entries received for that drawing. The winners will be notified via email. Winning is contingent upon compliance with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.
8. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, The Coca-Cola Company, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against all liability of any kind, including liability for warranties, representations or guarantees and any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of prizes will be awarded.
10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules.
11. Entrant's Personal Information: Information collected from entrants is subject to the Sponsor's privacy policy, which is accessible from www.thecoca-colacompany.com/privacy.html.
12. Winners’ List: For a list of prize winners and/or a copy of these Official Rules, send a self addressed, stamped, #10, business envelope to High Performance Beverage Company, 140 Sylvan Ave. Suite 3G Englewood Cliffs NJ, 07632 All requests for the Winners’ List must be received by August 8, 2008.
